POCA's

With the Proceeds Of Crime Act coming into force in 2002, the Government pursued criminals who had been convicted of certain offences if they believed they had benefitted from crime.

If you are convicted and a timetable is set for a Proceeds Of Crime Application (POCA) you will need legal advice and assistance. As in these circumstances an order can be made against you and you can be ordered to pay back any money they feel you have benefitted from.

If the money isnt paid back within a set period of time you can be ordered to serve an additional prison sentence. This does not cancel out the amount you have to pay so upon release you STILL have to pay the money.

It is extremely important that you seek the services of a Solicitor as soon as possible for expert help and advice in trying to reduce the amount of money the government wish to seize from you.

You do not necessarily need to be represented by the Solicitor who represented you in your criminal proceedings and may wish for a different Solicitor to have a look at your case.
